Giraffe Tax Credit Updates: IRS Proposes New Draft Tax Forms for EV Charging

Specifically, on January 13, 2025, the IRS released early drafts of Form 8911, Schedule A (Form 8911) which are the forms associated with the Section 30C Alternative Fuel Vehicle Refueling Property Credit.

These changes follow similar draft releases from October 30, 2024 of the Form 3468 for the Section 48E Investment Tax Credit.

These new Section 30C Forms and their associated instructions will apply to projects placed-in-service for tax years beginning in 2024 or later.

Key Things To Know

Section 30C - Alternative Fuel Vehicle Refueling Property

  • The key change is that the IRS introduced a new Schedule A (Form 8911) that will be required for each item of property placed in service
  • Whereas the prior version (Rev. January 2024) of the Form 8911 was a 1-pg document that required supplementary statements and worksheets to be attached to substantiate the 30C credit claim, the new version (Rev. December 2024) introduces a new framework with a 1-pg Form 8911 and supplemental Schedule A (Form 8911) required for each item of property
  • This update mirrors how the IRS handles electric vehicles, where a Schedule A (Form 8936) is required for each vehicle an organization claims, and then a single Form 8936 is used to roll-up all the Schedule As
  • The new Forms require additional information than what was previously required for each item of property, including for example requesting certification/permit numbers.
  • The Forms also reference the latest IRS guidance on census tract eligibility and GEOID determination per Notice 2024-64
